Further, Section 504 applies even if the private school receives the federal funding indirectly. Section 504 provides that private schools must merely provide "minor adjustments" to assist students with disabilities 34 C.
Major life activity is defined to include, without limitation, functions such as "caring for oneself, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working." Id. Private schools may receive Federal funding through may different avenues, including funding for school lunch programs, anti-drug programs, programs designed for at-risk students, educational reform programs, programs designed to enable student to meet national education goals, technology grants, government contracts, government loans, etc. The language of Section 504 applicable to private schools differs from that used in the Americans With Disabilities Act. In addition, Title I of the Americans With Disabilities Act, § 504, and the New Mexico Human Rights Act prohibit private schools from discriminating against employees or prospective employees with disabilities, if such persons, with or without reasonable accommodations, are otherwise qualified for the position.
We do this through a process that understands each student, individualizes a program to meet their needs and that builds a powerful sense of community.

Although students enrolled in private schools do not have the same right to special education as students in public school, IDEA does outline a pathway for dealing with private-school students with LD • The public school district where the private school is located is responsible for determining eligibility and developing the plan for special education services being found eligible (referred to as a “unilateral private placement”).
The guidelines below refer to the former situation.
Since IDEA contains a number of legal requirements for conducting evaluations, be sure that the process outlined and types of tests described in the Evaluation Notice reflect those requirements, are broad enough to provide a complete picture of your child, and take into consideration the concerns you have raised with the school.
Check with your state’s Parent Training and Information Center for state-specific information about evaluations and eligibility requirements. Should your child be found eligible for special education, the public school district where the private school is located provide special education and related services.
